Terms and Conditions
These Terms & Conditions (“Terms”) apply to all reservations and all persons included in or accessing the booking at Simula Cabins & Villas (“Simula,” “we,” “us,” “our”). The person who makes the reservation (“Booking Guest”) is responsible for ensuring that all members of the guest party read and comply with these Terms. By booking, paying, entering the premises, or staying at Simula, the Booking Guest and all guests in the party agree to be bound by these Terms.
1) Reservation Confirmation

Reservations are confirmed only upon receipt of required payment and booking confirmation from Simula via [email/SMS/booking platform].

Booking details (villa/room, dates, guest count, inclusions) are based on the final confirmed reservation.

Simula may request identity/payment verification for security and fraud prevention.
2) Check-in / Check-out

Check-in: 2:00 PM

Check-out: 11:00 AM
-
Early check-in / late check-out is subject to availability and additional charges may apply. Please request in advance.
3) Registered Guests & Entry Policy

Only registered guests are allowed inside the property.
-
Drivers/helpers are counted toward the total guest count.

Unregistered visitors may be refused entry and/or charged accordingly.
4) Security Deposit & Damage Policy

A security deposit is required prior to check-in and must be settled before entering the property.
-
The villa/room will be inspected after check-out.
-
Security deposit refunds are processed after inspection and released within a maximum of 48 hours, and in any case no later than 3 days after check-out, depending on processing and documented findings.

Damages/missing items are charged based on replacement cost + actual shipping, handling, and installation fees.
-
If deductions apply, Simula will provide a summary of charges.
5) Property Care & Use

No shoes inside the house (bring indoor slippers; available for purchase if needed).

No moving of furniture.

Guests must keep the property reasonably clean and use facilities properly.

Guests are responsible for any damage, missing items, or excessive cleaning due to misuse or violations.
6) Quiet Enjoyment & Guest Conduct

Guests must behave respectfully and avoid disrupting other guests, staff, or the community.

Simula reserves the right to refuse service, deny entry, or terminate a stay for serious violations, unsafe behavior, illegal activity, or disruption.

If a stay is terminated due to guest violation, payments remain non-refundable and additional charges may still apply.
7) Liability
Guests acknowledge that use of the property and its amenities is at their own risk. Simula Cabins & Villas is not liable for any accidents, injuries, illness, loss, theft, or damage to personal belongings that may occur during the stay, except where such liability cannot be excluded under applicable law. Guests are responsible for supervising children, seniors, and pets at all times, especially near water, stairs, elevated areas/rails, and outdoor pathways.
Guests also acknowledge that Simula is located approximately 30–40 minutes from the nearest city center, where essential services such as the hospital, police station, and public market are located. In case of emergency, Simula may assist in contacting the appropriate services, but response time and travel time may vary, and any related costs (medical care, transport, etc.) will be shouldered by the guest.
Waiver: Guests will be asked to sign a standard Guest Waiver/Assumption of Risk form upon check-in.
8) Force Majeure
Simula is not responsible for delays, disruptions, or inability to provide services due to events beyond our reasonable control (e.g., severe weather, power interruptions, government restrictions, natural disasters). Any accommodation (such as rebooking) is at management discretion.
9) Website, Online Booking & Third-Party Payment Disclaimer
9.1 Online Booking & Payment Processing
Our website may accept online booking requests and payments through a third-party payment gateway and/or partner payment channels. By booking through our website, you agree that:

Processing and posting times may vary depending on your payment method and bank/e-wallet/payment channel.

A booking is considered confirmed only after (a) payment is successfully completed/posted, and (b) Simula issues a booking confirmation.
9.2 Third-Party Payment Gateway / Payment Channels
The payment gateway and payment channels are operated by third parties. To the fullest extent permitted by law:

Simula is not responsible for third-party downtime, errors, delays, failed transactions, reversals, duplicate charges caused by bank/channel issues, or fees imposed by banks/payment channels/processors.

Payment authorization, posting, reversals, and settlement timelines may require coordination with your bank/payment channel and/or the third-party provider.
9.3 Website Accuracy & Availability
We strive to keep website information accurate and updated. However, rates, availability, inclusions, promotions, photos, and policies may change without prior notice. We do not guarantee uninterrupted access or error-free operation.
9.4 Limitation of Liability (Website/Online Booking)
To the fullest extent permitted by law, Simula shall not be liable for losses or damages arising from website use, reliance on website content, technical failures, or third-party services used in connection with the website (including payment providers, banks, e-wallets, OTAs, maps, and social platforms).
If Simula is held liable for any website-related claim, Simula’s total liability shall be limited to the amount actually paid to Simula for the affected booking/service.
9.5 Payment Disputes, Chargebacks & Fraud Prevention
Simula may require proof of payment and identity verification for online transactions. Unauthorized chargebacks or fraudulent claims may result in cancellation, forfeiture of booking privileges, and/or refusal of future reservations.
9.6 Indemnity
You agree to indemnify and hold harmless Simula Cabins & Villas, its owners, employees, and representatives from claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your misuse of the website, violation of these Terms, or infringement of any law or third-party rights.
10) Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be filed in the proper courts of [Province/City].
Cancellation & Modification Policy
A “modification” includes rebooking to a new date, changing villa/room type, or changing the length of stay.
3.1 Modifications Made More Than 30 Days Prior to Arrival

Modifications may be allowed without penalty, subject to management approval and availability.

Any difference in rates, peak/holiday pricing, or additional charges due to the modification must be settled accordingly.
3.2 Modifications Made 15–29 Days Prior to Arrival

Modifications may be allowed, subject to management approval and availability, and will incur a rebooking/modification fee of:

20% of the full rate, up to the full deposited amount.

Any rate difference (e.g., peak/holiday pricing) must also be settled.
3.3 No Rebooking / Modification Allowed (14 Days or Less)

Requests made 14 days (2 weeks) or less prior to arrival are no longer eligible for rebooking or modification.

The booking becomes non-rebookable and forfeited, and no refunds will be issued.
4) Special Circumstances
In extraordinary cases (e.g., natural disasters, medical emergencies, or other unforeseen events), Simula may review requests case-by-case. Supporting documentation may be required. Approval remains at management discretion.
5) Processing & Fees

Since Simula follows a no-refund policy, refund timelines for card payments generally do not apply.

If a security deposit is collected, it will be processed according to the Security Deposit policy in the Terms & Conditions (inspection-based, within the stated timeframe).

Any rebooking/modification fee and/or rate difference must be paid before the change is confirmed.

House Rules
By booking, paying, and staying at Simula Cabins & Villas, you agree to comply with our House Rules at all times. These rules are in place to protect the comfort, safety, and experience of all guests and our staff. We have zero tolerance for rude, disrespectful, aggressive behavior, or any actions that may put others at risk. Management reserves the right to refuse service or end a stay if house rules are violated.
